Assignment 2: Report
You are required to produce a Report of between 2,500 and 3,500 words on the following:
Testbury, a major retail company, has applied for planning permission to build a large retail store (7,500 sq metres) and 280 houses and flats, with associated car parking, on a 1.8 hectare site fronting Old Street, Islington.
The site is in the ownership of Islington Council, and is currently occupied by housing, a community centre, small retail units, a health facility, amenity space, garages and car parking.
A residents group has written to the Council raising 8 objections to the proposal:
a. it would cause the loss of the existing local health facility;
b. it would be contrary to national planning policies concerning retail development, and cause a loss of trade to an important local shopping centre in Whitecross Street;
c. it would cause a significant loss of trade to an existing local convenience store directly opposite the development site, and probable closure;
d. it would cause a loss of sunlight and daylight to the windows of houses adjoining the site;
e. it would provide insufficient affordable housing (20%) for local people;
f. it would fail to provide any scheme guaranteeing that local people are employed in the retail store;
g. the poor design of the public spaces will result in more incidents of crime and anti-social behaviour in the area, and increase people’s concerns for their safety and security;
h. Local people do not want the development to proceed: there is already a petition of over 3,500 local residents and businesses against the proposal.

The Chair of the Planning Committee has asked you to prepare a briefing report for local ward councillors on the process for dealing with this application, and to review the range of planning issues that can be taken into account.
Please answer the following questions in your Report:
1. Explain the basic legal and policy framework for considering the planning application, and set out the process leading up to making a final decision; and
2. Explain which of the above objections the Council will need to take into account as material considerations when assessing the application, why they are (or are not) material, and discuss the weight each might be given in the final decision. Explain the reasons for your conclusions concerning each issue.
Illustrate your answer by reference to legislation, case law, planning policy, and other planning guidance as appropriate.

INTRODUCTION –
Every new project or planning proposal to existing building, which causes a major change needs planning permission. Any land use or planning system cannot be implemented without the permission of local planning authority. Development at white cross street, is controlled by the council of Islington, which is responsible and authorised body for any commercial or residential planning permission. Among all the local authority in London, Islington council is the one of the development authority, with an area of six square mile and approximate population of over two lacks. This authority is one of the smallest controlling authority in the capital neighboured by Camden, Haringey, hackney and city of London.
Council of Islington is the development authority which looks at various community in terms of culture, economic growth and environmental issues. According to the council life event section –“Our Life Events section covers both information that will be important to you as you live to Islington. Whether you are moving into the borough, having a baby, looking to change career or are caring for someone, this section should help you get started”.

In the case Testbury proposal at Islington, this project is proposed for the development and feasibity in whitecross street.The arear for the site is 1.8 hectare and planning to built retail market, housing and flat scheme to the existing houses, community, health centre and parking space.this site is owned by council of isliington. According to SPD and statement of community involvment, planning authority must involve the community for planning and proposing development under council area. Its council responsibility to aware people before planning and proposing any development by any mean.
If the residential or local citizens raised any objection against any proposal, it is council liability to consider the materialistic objections and replan the development policy,which is for the balance community and sustainable growth of area.

Local development framework consist of planning policy documents, which is termed as local development documents (LDD). The development plan documents are prepared for planning preparation with clear procedure to elaborate the policy framework, supplementary documents are prepaired to explain the planning proposal in development plan document and report of various consultation with public.
The main objective of the Local Development Scheme is to:
To aware and involve the developer, inverstor and local community for decision making and planning development for area and community development (Planning and Compulsory Purchase Act 2004)
To consult with the local residents at first stage of proposal to get the reaction of people on planning proposal with respect to the arial development and effect of the planning policy on future development.
Preparation of every three year plan, and provide information to stakeholder and community people by various mode to encourage developer and residents to actively involve in development plan prepairation.
To set out the work programm according to the development plan priorities and get government approval for implementation of proposed program which is most essential part of planning development scheme.

1.1 The Planning and Compulsory Purchase Act, which came into force in
September 2004, introduced a major reform to the planning system in England and
Wales. The main aims of the planning reform are to speed up the planning system,
increase its flexibility and enable greater community involvement in the planning
process. The reform also changes the emphasis in development planning towards
shorter, streamlined plans which would have a clear, strategic vision and have more
of a spatial dimension. Formulating spatial rather than purely land-use policies
would provide for a more holistic approach to planning. In addition, development
plans will be required to reflect aims and priorities contained in the Council’s
Community Strategy, as well as other corporate plans and strategies.
DPD and does not include Independent Examination. The preparation procedures
for both DPDs and SPDs are set out in Appendix 1.
1.3 It will be possible to revise individual parts of the LDF, thus enabling planning
authorities to respond to changing circumstances and keep their plans and policies
up to date. The new system will be a continuous programme of plan revision.
1.4 Local Development Framework also includes a Statement of Community
Involvement (SCI), which sets out the minimum standards for community
involvement in both plan making and in the decision process on planning
applications. Islington’s SCI was adopted in July 2006.
