Legislation and Codes of Practice Every child matters Safe guarding Crb enhanced ISL Data protection act Equality act Professional standards in teaching 5 Legislation and Codes of Practice There are numerous laws that are relevant to teaching. Health and safety in education Health and safety responsibilities in education derive from the Health and Safety at Work etc. Act 1974 and associated regulations. The health and safety of staff, students and visitors whilst on premises, or involved in organised activities (e.g. educational visits), must be protected as far as is reasonably practicable using risk assessments Data Protection in education Data Protection Act 1998. This means, among other things that the data held about students must only be used for specific purposes allowed by law. Safeguarding Children and vulnerable adults The Safeguarding Children and Vulnerable Groups Act 2006, introduced a new vetting and barring scheme for all those working within education From October 2009, a new duty to share information and a set of increased safeguards have been introduced and administered by the Independent Safeguarding Authority (ISA). It looks at the recruitment and selection processes, specifically the introduction of enforced CRB checks. This ensures safeguarding and child protection. Other laws relevant to teaching include the Disability Discrimination Act, Equal Opportunities, Sex Discrimination etc. The above laws have now been incorporated into the Equality Act. The Equality Act 2010 The purpose of the Act was to bring together the complicated and numerous Acts and Regulations which formed the basis of anti discrimination law in Great Britain. These included, primarily the Equal Pay Act 1970, the Sex Discrimination Act 1975, the Race Relations Act 1976, the Disability Discrimination Act 1995.
