Identify the key aspects of current legislation and codes of practice relevant to your subject and the type of organisation within which you would like to work.
All organisations whether private or public sector will have legislation and codes of practice to comply with.
Within every workplace the Health and Safety at Work etc Act (1974) is applicable - All workers have a right to work where risks to their health and safety are properly controlled. Health and safety is about stopping you getting hurt or ill during work. The employer is responsible for health and safety, but you must take reasonable care of yourself and others.
The Management of Health and Safety at Work Regulations (1999) says risk assessments must be carried out to identify any risks or hazards either to workers or visitors.
The Equality Act (2006) aims to eliminate discrimination, inequality and protect human rights so everyone has a fair chance to participate in society.
The Disability Discrimination Act (2005) places a duty to promote equality of opportunity for people with disabilities.
The Sex Discrimination Act (1975) makes it illegal to treat men or women less favourably dependant on their sex.
The Race Relations Act (1976) makes it illegal to discriminate on the basis of colour, race, nationality, ethnic or national origins.
RIDDOR. Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (1995).
Additional legislation more relevant to the ground care industry is:
COSHH – Control of Substances Hazardous to Health Regulations (2002) refers to the use of pesticides, exposure to dust, fumes, etc. This is done by keeping a Pesticide Application Record book and Pesticide Record logbook.
LOLER – Lifting Operations and Lifting Equipment Regulations (1998). Done by training and certification.
PUWER – Provision and Use of Work Equipment Regulations (1998). Equipment must be suitable for the job, safe and well maintained. Users are to receive adequate information, instruction and training. Done by issuing instruction manuals, clear orders and recognised training qualifications. These are then transferred to everyone’s personal record.
PPE – Personal Protective Equipment at Work Regulations (1992) covers the provision, maintenance and use of PPE at work. This is monitored by using a PPE Issue Book, where all PPE issued is signed for by the recipient.
Manual Handling Operations Regulations (1992) on safe handling and lifting techniques. All personnel trained in manual handling and other methods eg. Buying lighter bags, loading bucket / pallet forks for tractor assisted loading, etc.
The Control of Noise at Work Regulations (2005). Employees’ hearing is protected from excessive noise. All personnel issued with ear protectors and using machines with quieter engines, etc.
The Hand-Arm Vibration Regulations (2005) control the health risks from exposure to hand-arm and whole body vibration. This is done by monitoring machine usage on everyone’s timesheet. This is also monitored yearly with a health screening by the Occupation Health Section.
The Council have whole departments looking at current legislation and codes of practice, offering guidance and monitoring for managers and workforce.
