Branches of Government Sheila Dorsey HIS/301 February 21, 2011 Stephen Plummer Branches of Government This paper will discuss the three branches of government. The paper will also include why the founding fathers divide the government into the legislative, judicial, and presidential branches and how they came up with the idea and if the system works successfully. The paper will discuss how the three branches are equal in power and how Alexander Hamilton, referred to the judicial branch as the least dangerous branch because of it’s lacked in power of the legislative and executive branches. The paper will discuss the division of power obstruct the enactment of important legislation and if it is a good or bad thing. The paper will discuss if Hamilton were still he would he still say the same about them and why or why not' The founding fathers divide government so that particular parts of the government would not have too much power. Each branch has a defined and limited role and the ability to check the power of the other branches. Checks and balances and Separation of powers help the government from becoming tyrannical force that they had broken away from under English rule. The U.S. Constitution is what separates the three branches of government and is a result of a compromise on the central government of the U.S. and its responsibilities that was proposed at the Constitutional Convention of 1787. The new constitution was officially signed on Sep 17, 1787 but was officially ratified by the ninth state that created the majority it needed and took effect June 21, 1788. John Locke was the first to pioneer the idea and only suggested the separation between the executive and legislative. Charles Louis added the judicial branch. The U. S. outlines the three branches of government; the executive branch is represented by the President, the judicial branch with the Supreme Court at the head and the legislative being the people’s branch which is represented by Congress. The original constitution was to have the legislative to be the powerful, but over the years the executive has gain the power. The system works successfully according to the checks and balances of the government. Constantly reading about gridlock in our national government because of the legislative branches giving the power to make the laws this gives the check over the executive branch. The legislative overrides presidential veto with two-thirds vote. It has the power over purse strings to actually fund any executive actions. The legislative branch has checks over the judicial branch to create lower courts. It may also remove judges through impeachment. The three branches are equally in power as they work together unless it is challenged by another power this is to ensure that the states keep their sovereignty, freedom, and independence. The judicial branch is unlike most national judicial systems it yields great political power and must be counted as part of the political system. Someone should go to the court first the court does not take initiative to do so. The judicial branch system tends to manage court cases on all levels that includes local, state, and federal. Federal cases have higher penalty under conviction. The judges of federal court case are strict and they both are just. When and if found guilty in the federal court the person must face sentencing of a variety of variety of punishment. Punishments tend to include death penalty along with prison sentencing. The judiciary is the safeguard of our liberty and of our property under its constitution. The goal of the judicial branch is to hold the people accountable of their crimes and to keep justice in the land. Farmers believed that all three branches would tend to work together to govern not only for the good of the people, but for the good of the states, and the nation as a whole. This is why the Federalist stood for a strong central government, and the Anti-Federalist stood for individual and states right. After much debate the two sides came together and settle their differences. The three branches of government were created for many of reasons. The first is important to understand the state of mind that surrounds the government creation. How the colonies had won their independence from England and form their union in thirteen states that was governed by the provision that was laid out in the Articles of Confederation. The Articles of Confederation was one of the main principles to create a week national government that held no supreme power over difference at the state level. The legislative branch is responsible of making the laws and is the most important branch of the Unites States is the executive branch and it makes sure that laws of the constitution are exceptional obeyed. The healthcare reform would be considered the health legislation for now. The bill is one that would make history if it is passed. The only bill to pass in regards to all Americans having health insurance. The United States are historically sensitive to the federal actions that tramp on the constitutional rights. The branches tend to use a system known as checks and balances. Thus the branches can gain too much power and influence, and reduce that opportunity. There is a simply amount of power the senate holds in addition to relating to treaties and the appointment of executive and judicial officials. The power is know as consent and advice. This is required from the President to appoint by the executive officers and judges which is the Senate’s advice and consent. The filibuster is the only bill to be debate by the Senate. The filibuster is controversial. The Senate also has the power to bar an individual for federal office. The Senate cannot impose any punishment although the parties are subject to a trail in the courts. This would be what would be opposed to be the now for which are identify as specific issues of then and now. Many are which are still unsure of if they will take place. References T. E. (2009).
