Your responsibilities and those of others who have an effect on your work Legislation and codes of practice to govern Assessors/Trainers When I am dealing with learners up to the age of 19 years of age I have to adhere to the children act 2004 legislation that includes Being healthy e.g. A learner able to leave the room to go to the toilet, Staying safe e.g. Learners are encourage to leave the room calmly, Enjoying and Achieving e.g. Teachers praise learners, Making a positive contribution e.g. Learners contributing to a discussion without discriminating and Achieving economic wellbeing e.g. Learners evaluate their progress. Other Legislations and regulations that I need to have an understanding and adhere to that are relevant to my area of work as a work based Assessor in warehousing are as follows: Health and safety at work act of 1974 Under this legislation it states that all individuals and organisations have a duty of care with regards to the health and safety of themselves and any of their actions that could have an effect on others. SENDA 2002 Is an act that states that college and educational institutions have a legal requirement to provide reasonable adjustments for disabled learners and to provide equal opportunities within the learning environment. Sex Discrimination Act 1975 This states it is illegal to treat a woman or a man less favourably on the grounds of their sex or marital status. E.g. A man being paid more money than a woman for doing the same job. Race Relations Act 1976 This act states it is illegal to discriminate on the grounds of colour, race, and nationality ethnic or national origins. Gender Reassignment Act 1999 This act is in conjunction with SDA to cover discrimination to people which is undertaking medical supervision for the purposes of reassigning a person’s sex by changing physiological or other characteristics of sex. Disability Discrimination Act 1995 Within this act it makes it illegal to treat someone with a disability less favourably than other people, unless there is a justifiable reason to do so. Word count 326 Equality, diversity and Inclusion Within my job role as a work based assessor in warehousing I would promote Inclusion, Equality and Diversity with current and future learners by firstly finding out if the learners that are going to be on my course have any learning or additional learning needs. I would do this by looking at completed enrolment forms and carrying out an initial assessment tests, or by learners completing a word assignment when the course application is complete. Once we are aware that the learners have additional needs then I can put measures into place to provide support to the learners. It is very important that I establish and create an ethos of respect and dignity within the group. Sometimes discrimination can be caused from lack of knowledge and ignorance When I have learners who have additional needs, I ensure that I plan and show planning, and provide support and resources to them, I ensure this doesn’t have a negative effect on the rest of the group. Sometimes I might need to challenge my own beliefs, values and attitudes to offer support. Additional support can be obtain some learners may have difficulty in writing English, so if I would assist them on a one to one. I would differentiate the work to learners and what work I will be expecting back from them. Special educational needs 2002 states we have to adapt the curriculum to meet the individual needs of the learners. If I have learners with additional needs they have points of referral for certain area’s such as learner guides, skills for life for staff & students, customer services, counselling, prayer room, student advisors, crèche, first aid, health & safety, choices clinic and staff support. Internal and external assessments Keeping records There are many reasons for the need to complete and keep certain document which could be because it is a legal requirement such as registers and records of learner contact, other reasons may be for traceability, tracking learner’s progression and audits to prove the company is meeting awarding body requirements. In my job role as a NVQ assessor in warehousing some information on records, portfolios could be confidential so these may be needed to be kept in a lockable cabinet so there is restricted access to this information, to ensure I am adhering to the data protection act. Also by obtaining records and making sure they are up to date, if my colleagues had to pick up one of my lessons due to illness or other reasons, from looking at the related documentation they would know what progress has been made to continue with the sessions. The various types of records that we have to keep are: Scheme of work- This is completed for the full length of the course and indicates on a weekly basis the activities the learners will complete within a specific group. Lesson plan- Is planned for every session the tutor delivers which they can refer to throughout the day as the tutor will have recorded of any aims and objectives, activities planned with any handouts stated. Course register – Is a legal document that lists all learners on the programme and indicates if learners attendance or have been withdrawn from the course and the reasons for doing so. Tracker sheet – Will provide all information on the learner from personal data also dates that they were registered with the awarding body and registration number. This form will help the tutor by identifying progress been made by the learners. Observations – An observation sheet is a document which is used as a method of assessment, this will be used to record the learner performance so the evidence can be matched to the course performance criteria. Enrolment form- As they have all personal information about the candidate (data protection act) Individual learning plan- They are completed by the tutor with the learner at the start of the programme. It indicates if the learner has any additional learning needs, their qualifications. This documentation is completed several times throughout the course.
