K3C155 – Research the legal requirements covering the way you relate to and interact with children
There are legal requirements covering the way in which you relate to children and how you interact with them. These are the key pieces of legislation:-
• United Nations Convention on the Rights of the Child
• Human Rights Act 1998
• Data Protection Act 1998
• Protection of Children Act 1999.
• The Children Act (1989)
• The Race Relations Act (1976), Amendments (2000) and Regulations (2003)
• Disability Discrimination Act (1995)
• The Sex Discrimination Act (1975)
For example when interacting with children I should always treat them as a valued human beings treating all children with respect and dignity, providing guidance through praise and encouragement, these are the acceptable ways to relate and interact with children.
The unacceptable behaviour includes the ill treatment of children in many forms i.e, physical punishment, verbal abuse, deprivation of food. This is required by law under the Children Act (1989), which states children have a right to be treated like a human being. It is a set of regulations and guidelines for early childhood education services. The way in which adults behave with and towards children in the childcare environment forms part of these regulations. It provides legislation relating to the ways in which adults should behave and a range of practises which are unacceptable behaviour.
Furthermore, all interactions with children should not be biased or in any way discriminatory, and in a group no child should be excluded and I should not show favouritism or prejudice. I should also provide the children with the key things stated in the Every Child Matters policy – i.e. whatever the child’s background or circumstances - they should have the support they need to:
• Be healthy
• Stay safe
• Enjoy and achieve
• Make a positive contribution
• Achieve economic well-being

The legal requirement for confidentiality would be that all confidential information should be stored in a locked cupboard and if there are any records on computer, they must be registered on the Data Protection Register according to the Data Protection Act of 1984/1998. When disclosing information you must respect confidential information about children, as long as doing so will not affect their welfare. If, for example, you suspected that a child was being abused, you would have a legal duty to disclose this information, but only to the relevant person or authority.

All children have the right to participate in society and to be given equal opportunities regardless of whether they have a disability and/or special educational need. The main laws that safeguard these rights are:-
• The Disability Discrimination Act 1995
• The UN Convention on the Rights of the Child
• The Care Standards Act 2000
• The Special Educational Needs Code Of Practice.
