Juvenile and adult court
There are a lot of differences between juvenile court and adult court. In a lot of places the terminology that they use during the proceedings are different. In adult court you have phrases like Bail hearing, Trial, Complaint or Indictment, Defendant, Verdict and guilty. When it comes to juvenile court the same phrases above are said in a different manor like these, Detention hearing, Fact-finding hearing, Petition, Respondent, Adjudication and Delinquent or Involved. In adult court you will be put in front of a jury and a judge but when you are under the age of 18 and being convicted of a crime it is usually just a judge that hears the case and then he or she will decide whether or not you are guilty. There are some really big differences in the procedure. Another difference is that bail is usually not granted to minors. To get out of custody before adjudication, the minor will have to prove that they are not a flight risk and they will also have to show that they are not a danger to the community. Also, Juvenile court is closed to the general public this includes the media. For smaller offenses, the consequences for the minors may be worse than what they are for the adults. Minors tend to be places in probation longer periods than adults. The conditions of their probation can be more obnoxious as well with things such as curfews, getting adequate grades, behaving respectfully to parents the list goes on and on with the different things they can and will do when it comes to minors on probation. On the other hand, minors who are found delinquent in serious cases and incarcerated may be better off than adults since their sentences will typically en when they are in their twenties where as an adult may receive life in prison for the same crime. Sometimes minor are tried in adult court if the crime is very serious, something like rape or murder. This will usually happen to somewhat older minors aged from thirteen to seventeen.
The definition of delinquency is an offense or misdemeanor; a misdeed. There are other meaning of the word as well. Another is a failure to to do what the law or duty requires and it can also be a debt or other financial obligation that the payment of is overdue. The first meaning that I mentioned is what is considered to be a juvenile delinquent.
A status offense is an action that is prohibited only to a certain class of people, and most often is applied to offenses only committed by minors. Status offenses may include consumption of alcohol, tobacco smoking, truancy, and running away from home. These acts may be illegal for persons under a certain age, while remaining legal for all others, which makes them status offenses. These offenses may also apply to other classes such as a felon who is caught owning a firearm, which is legal for people who are not felons. Laws that prohibit certain actions to certain persons based on their sex, race, nationality, religion, etc, are also status offenses. A law that prohibits men from using public toilets intended for women, or a law that sets a curfew for people below a certain age, are examples of status offenses, although they are not always thought of as such.
There are a lot of things that people correlate with juvenile crime rates. I think that one of the first things that people relate to it is how the parents raised them. They will ask questions like were the parents abusive' If they may have been sexually abusive or if they actually didn’t punish their kids enough. Children with strict parents do have a tendency to rebel against them and purposely do things that they know that they are not supposed to do just to make their parents upset or because they don’t care about the rules that their parents have set in front of them. Another thing that people can correlate with juvenile crime rates are the areas that they are living in. If a child is being raise in a bad area, that will reflect on their behavior not necessarily because they are bad people its just things that they have to do to get along in the area that they are living in. You can see examples of this with people in gangs, they try and recruit the kids young making them think that they are in some sort of danger if they don’t become part of the group and then they offer them protection if they are part of the group. A lot of kids join up with these groups because they like the feeling that they get when they are with them, they feel cool, protected and that they have friends. Another way that you can correlate the juvenile crime rate is how they act in our schools. Kids have a lot of things that they deal with in school now a days, feeling that they need to fit in and dealing with bullies and just trying to find their “click”. Some of these kids are committing these crimes because of the people that they are hanging out with that they go to school with. They are trying to fit in and want to be cool to the people that they are hanging out with so they commit a crime with.
Some of the recommendations that I have to reduce juvenile crime are a few things. As far as parenting goes I would say that the parents need to talk to their kids and understand what they are feeling and keep an eye on who they are hanging out with and getting to know their parents and just be involved. Another thing that parents can do is to look for some of the classic signs of kids having trouble with something, like if their grades decrease and they become less social and have a bad attitude about things. For the people that are living in a bad area there are a some programs that people can put in the neighborhoods and give them something to do other than being out in the streets all day and night. Just some thing that will keep them off of the streets and keep their minds busy with things that theycan do for the community or something like that to make it a better area.
