Explain key aspects of relevant current legislative requirements and codes of practise within specific context - www.hse.gov.uk – www.ipaf.org I teach a range of courses that all contain information regarding Health and Safety legislation and Codes of Practice. I explain on the course the difference between a Health and Safety Act or legislation and a Code of Practice by offering the following explanation • Health and Safety Legislative requirement: A duty to act according to the law as defined in an Act of Parliament and usually enforced by or through the courts. • Code of Practice: A set of rules outlining how a person in a particular profession or situation is expected to behave. • Statutory code of practice: A Code of Practice approved by Parliament and admissible as evidence in any legal action There are several health and safety codes of practice and statutory instruments (additions to Acts of Parliament), which may impact on your teaching role. Some examples are: Legislative requirements that can be used • Manual handling. Manual Handling Operations Regulations 1992. • Management of Health and Safety at Work Regulations 1999 • Provision and Use of Work Equipment Regulations 1998 (PUWER) • Lifting Operations and Lifting Equipment Regulations 1998 (LOLER) • Control of substances hazardous to health (5th edition): the Control of Substances Hazardous to Health Regulations 2002. • Work with display screen equipment: Health and Safety (Display Screen Equipment) Regulations 1992 as amended by the Health and Safety (Miscellaneous Amendments) Regulations 2002. Codes of Practice • BS EN 280:2001 Mobile elevating work platforms : Safety by design • BS 8460 Mobile Elevating Work Platforms : Code of practice : Safe use • BS EN 1495:1998 Mast climbing work platforms : Safety by design • BS ISO 18878:2004 Mobile elevating work platforms : Design calculations, safety requirements and test methods These are the legislative and codes of practice used to design and form a basic template for a training course. When preparing a course the building blocks should always consider the following: Disability Discrimination Act 2005 – this requires the course or the training provider disabled access to the training and reasonable adaption’s to the course that may be required. The law requires the same consideration to the long term ill. Race Relations Act 1976 and the Race Relations Amendment Act 2000- this forbids discrimination on the grounds of race, colour, nationality or ethnic origin. Sex Discrimination Act 1975 – Forbids discrimination on the grounds of gender or marital status. Data Protection Act 1998 – allows organisations to retain personal data about individuals when it is required for a specific purpose for such time as deemed necessary for that purpose. Management of Health and Safety at Work Regulations 1999 – Designed to prevent unsafe practices and to minimise workplace injuries, incorporates risk assessments, fire procedures, first aid and the safe handling of medicines.
