eTMA1 Question 1 Read the extract in Box1 and explain it in your own words. The word plagiarism originates from the latin word “plagiarius” meaning “kidnapper”. This describes the basic principles of a plagiarist, someone that “kidnaps” work which is not their own. Whether a person is not entirely assured with their academic ability or they may display an inadequate knowledge of what is required in there chosen level of study, these could be the reasons that lead them to replicate another persons work. This can be identified as plagiarism. There are several interpretations of what constitutes as plagiarism. This can be copying another persons work in its entirety, by getting another person to complete work for them and by altering certain parts of someone else’s work with the intention of passing this off as their own. There are numerous degrees of severity to plagiarism, starting with plagiarism, intentional plagiarism, plagiarism with intentional fraud. An example of this is if a student, who is not confident in their abilities, is set an assignment and they search the internet for information. They come across a completed piece of work, they proceed to copy the completed piece of work changing no part of it, they then hand in the assignment as their own. Using this extract only, answer the following questions. a) According to the extract who can decide if someone is trespassing on land' As stated in section 61(1) and 61(4) of the Criminal Justice and Public Order Act 1994 a Senior Police officer can decide if someone is trespassing on land. b) How many people need to be on the land before it might be considered trespass' As stated in section 61(1) and 61(4) of the Criminal Justice and Public Order Act 1994 for a person to commit Collective Trespass, there needs to be two or more persons present. c)According to the extract what else needs to have happened, aside from the people being on the land, before a police officer can direct the person to leave the land' Section 61(1)(a) of the Criminal Justice and Public Order Act 1994 states that a senior police officer needs to confirm whether any persons present have caused damage to the land or property or used threatening, abusive or insulting words towards the occupier, a member of his family or an employee or agent of his. Section 61(1)(b) of the Criminal Justice and Public Order Act 1994 states that when those persons have between them six or more vehicles on the land and to be sure that the other conditions specified in subsection (1) are satisfied after those persons became trespassers before he can exercise the power to remove them from the land. d)According to the extract what happens if someone who has been directed to leave the land fails to do so as soon as reasonably possible' As stated in section 61 in the final paragraph of the Criminal Justice and Public Order Act 1994, if a person fails to leave the land as soon as reasonably possible after being directed to do so, he is commiting an offence and is liable on summary conviction to imprisonment for no longer than three months or a fine not exceeding level 4 on the standard scale, or both. e)According to the extract what happens if someone who has been directed to leave the land goes back onto the land' As stated in section 61 in the final paragraph of the Criminal Justice and Public Order Act 1994, if a person has left the land as a trespaser and enters the land as a trespasser within the period of three months beginning with the day on which the direction was given, he is commiting an offence and is liable on summary conviction to imprisonment for no longer than three months or a fine not exceeding level 4 on the standard scale, or both. As stated in section 61(1)(a)(b) of the Criminal Justice and Public Order Act 1994 the powers to remove tresspassers falls directly into the responsibility of the senior police officer present. In section 61(1) and 61(4) of the Criminal Justice and Public Order Act 1994 for a person to commit Collective Trespass, there needs to be two or more persons present and the senior police officer present needs to confirm whether any persons present have caused damage to the land or property or used threatening, abusive or insulting words towards the occupier, a member of his family or an employee or agent of his. Section 61(1)(a)(b) and 61(2) of the Criminal Justice and Public Order Act 1994 states that where those persons in question are reasonably believed by the original senior police officer to be persons who were not originally tresspassers but have become tresspassers on the land, the officer must reasonably believe that the other conditions specified in subsection (1) are satisfied after those persons became trespassers before he can exercise the power to remove them from the land and to remove any vehicles or other property they have with them on the land. As stated in section 61(4)(a)(b) and in the final paragraph of the Criminal Justice and Public Order Act 1994, if a person fails to leave the land as soon as reasonably possible after being directed to do so, or has left the land as a trespaser and enters the land as a trespasser within the period of three months beginning with the day on which the direction was given he is commiting an offence and is liable on summary conviction to imprisonment for no longer than three months or a fine not exceeding level 4 on the standard scale, or both. As mentioned above the powers to remove tresspassers under section 61 of the Criminal Justice and Public Order Act 1994 falls to the senior police officer present. It is their judgement which will determine whether an offence has been commited with regards to trespassing, under the guidelines of the Criminal Justice and Public Order Act 1994.
