Questions
Imagine you are a newly appointed supervisor/manager within your service. You need to update your staff handbook to reflect current employment law.
Identify three sources of information you could use to enable you to do this.
www.homeoffice.gov.uk - This website is about the equality act 2010 and explains what it covers. This document explains the laws according to the government’s expectations.
www.ofsted.gov.uk – This websites is the office for standards in education, children’s services and skills. This consists of rules and regulations that need to be adhered to within the work setting. Also explains what its expectations are of capable well managed work setting that provides the staff, children and other companies involved in providing care and service within the nursery’s surrounding areas.
www.acas.org,uk – this stands for advisory, Conciliation and arbitration service. This service helps manage and organise employees/employers to improve working life within the setting regarding employment relations. They supply the settings with up-to-date information, they offer independent advice, training and support with problems at work and improve performance.
Once you have identified a reliable source of information:
A) list three aspects of employment covered by law
Every aspect of employment is covered by law. The first of any form of employment needs a contract, the employee must have a contact of employment. There is a whole series of laws that relate to the conditions of work, these include:
* Minimum wage
* Hours worked
* Holiday entitlements
B) List three main features of current employment legislation
The spectrum of employment law in the UK covers three main areas.
*Employment Rights
*Equalities and Discrimination law
*Health and safety legislation.
Aiii) briefly outline why employment law exists
This law exists to regulate the contractual relationship between two parties of unequal bargaining power; the employer and the employee. For instance if the law wasn’t in place then otherwise you could be a target of unfair treatment at work place, you could be made to work for 2p an hour, you could be endangered at work, or face bullying or discrimination. You could be sacked at any time for no reason, made to work for 48 hours straight without a rest, not allowed to go to the toilet at work etc. It is to maintain an equal, fair and healthy working environment for an individual to work in.
