An alternative dispute resolution clause prevents disputes, miscommunication, and increases the performance and expectation of objective and goals of the learning team. In this paper it identifies the meditation method to resolve a dispute and identifies all provisions necessary to enable alternative dispute resolution to occur in the learning team (Menkel-Meadow, 2002). The clause also provides all the information needed for the ADR process to work efficiently and effectively.
The learning teams created an alternative dispute resolution the helps resolve disputes or conflicts within the team. Alternative dispute resolution has many alternative dispute resolution processes. The learning process includes the mediation process in which a third party usually a natural and unbiased facilitator a negotiation agreement among the parties in disagreement.
That ADR process includes the meditation method the helps resolve the dispute. This method includes a third party that is neutral and unbiased. The neutral and unbiased party helps facilitate and negotiation between disputing parties. Each party forms an opinion and the neutral party shares the opinion between parties. The neutral party will then render a formal decision and arbitration will then take place between the parties themselves until a decision is rendered. The evidence from each party is presented and the neutral party will present the decision.
This process can work in any learning team environment. The alternative dispute resolution will help promote goal setting, efficiency, role clarity, and fairness within the team. ADR will help improve performance and recognition with the learning team.
