Each member of the learning team will agree to participate in mediation as the primary method of negotiation between members of the team in the event a disagreement or dispute arises. “Mediation is a process in which both parties meet with a neutral mediator who listens to each side explain its position.” (Jennings, 2006) A disinterested and impartial person for whom the instructor shall randomly assign a student who is not a member of the learning team experiencing a disagreement or dispute will carry out the role of the mediator. The mediator will not issue a decision; instead the mediator will strive to find a resolution that all members of the learning team will agree upon. Mediation must maintain its confidentiality in such no other students will be made aware of the existing problems amongst the learning team. The disputes that are subjected to the mediation process include a breach of agreement by any member of the learning team not fulfilling his or her assigned role and responsibility, directly or indirectly disrespecting a member of the learning team in any shape, form or manner, and withholding support to a member who requires assistance. The rule of engagement is as follows: Each member of the team will respectfully listen to each other’s comments or inputs regardless of their personal opinion, agenda, or bias. In the event the mediation process does not resolve the irreconcilable differences from any members of the team, the next step is to inform the class instructor/facilitator of the problem deemed unsolved by the mediation process. The instructor would have already been requested and appointed to act as the arbitrator, who will make the final decision into finding a solution for which all members will agree and adhere to.
