Supreme Court Decisions Jon Hartman USHG per 5 January 7th 2003- Supreme Court Cases 1. 1803 Marbury vs. Madison Constituional Principle: Seperation of powers; the judiciary Backround: For political reasons, Jefferson and secretary of state James Madison refused to allow William Marbury, one of the “midnight judges”, to take office as the District of Columbia’s justice of the peace. Marbury appealed to the Supreme Court to force the Jefferson administration to allow him to serve his appoinment. Decision: The Court decided that Marbury’s request for a writ of mandamus was based on a law passed by Congress that the Court held to be unconstitutional. The Court decided unanimously that the federal law contradicted the Constitution, and since the Constitution is the Supreme Law of the Land, it must reign supreme. Through this case, Chief Justice John Marshall established the power of judicial review: the power of the Court not only to interpret the constitutionality of a law or statute but also to carry out the process and enforce its decision.
