Sexual violence is a constant attention in post-secondary education environment. Any violence, physical or psychological, through sexual manner or targeting, including sexual abuse and attacks, rape and sexual harassment. Sexual abuse is often tolerated the campus (Joseph, gray, & meyer, 2013). Although people of either sex can experience sexual violence, high-risk women victims and the vast majority of men is the murderer.
North American studies have shown that 15-25% of women can experience sexual assault in her academic career (Abbey, A., & Jacques-Tiura, A. 2011). Because most of the women in their early 20s, post-secondary students generally, young women are right on highest risk of sexual assault, the incidence of sexual violence on campus will fuel (Faulkner, E. 2006).
Introduction
During the case what we chosen is occurred in 2012, the girl is a freshman at the university and only went to school for two months. Due to the interests and hobbies. She has participated in the school football club and enjoys the activities. According to the survey, in the early, offender has flirted and harassment the girl, but the victims were not vigilant. The case occurs in a pre-party, the offender with the other friends in the club drunk with the girl and then raped her. It should be noticed that the girl is the black girl and the boy is white, thus why the case becomes more special than others.
The victim pointed out that when she was hurt after investigation. Most people think the main responsibility lies in her own. They thought that the main reason is the result of her drinking. Even some people in the school thought she brings a shadow over school. As a black, most people not to help her but suspect her. This made her feel very hurt.
Race analysis
It is obvious that the race factor has a great effect on this case. Since the girl is black girl, make most people suspect her. Even for the police and school, also seems more trend for the white boy. The results in this case also make people feel unsatisfied. The boy only gives some money to the girl and stops his class for one year. But the girl finally gives up her study and transforms to another school. It is no doubt that the race effect the quality of the justice. The punishment of the boy is not enough and makes people to suspect the justice of law. Of course, not enough evidence also generates the unsatisfied results.
Sex analysis
There is no doubt that in this case, female is in a state of great disadvantage. Both public opinion and the surrounding environment, it is a trend to blame women. Most of the time, people will feel that happening is the own irresponsible of girl.
Alcohol and drug are abuse on campus, facilitated sexual assault is a consideration of drinking rate and substance use in American colleges. Though alcohol is often rated as one of the reasons that campus sexual assault, studies show that criminals could drink of reason or prove their behavior, and other variables such as impulsive and peer group norms may lead to increased drinking and sexual assault crime(Krishovey, M.S., Hayes, R., Klein, E.G., Nemeth, J.M., & Adkins, R. 2013). When sexual assault connects with the alcohol or drug, people more trend to blame girl than boy. Gender discrimination is clear and makes people feel lose.
Income analysis
Since both connected people are student, maybe some people just think that the income is not influence the justice of this case. However, the fact is not. According to the report, the boy’s father has consecutive donated to the school for two years. Consider the result of the case. It is hard to ask people not to wonder about the connection. The boy’s father also paid up high number bail for his son. On the other hands, if the girl is coming from one of the famous or high income family, maybe the result will be different.
Discussion
As for the girl, it must be unjust for her encounter. The incomplete law generates the unsatisfied result and makes people felt sad. For the feminists, this case reflects the related law system of loopholes and problems. In order to avoid those cases occurred again. It is necessary for students to learn how to protect themselves, especially for the female. On the other hand, it is also needed to complete the related law in order to provide the project for the victim. Nowadays, the relevant legal protection in the United States about the educational equality, campus crime statistics and security policy are enough, but there are also various problems existed in practice. Most schools choose to ignore or reduce the right of the victim in order to avoid legal liability. Usually there are two solutions can be chosen for the victim, private litigation to obtain compensation or reported to the ministry of education schools.
The institutions of higher education must solve the sexual assault as distinct from other types of misconduct. The gender power dynamics and the unique challenges encountered by the victims.
