Wayne Boden was a Canadian serial killer and rapist who committed four murders during October 1969 to May 1971. Four women victims were killed cruelly by Boden.
The first victim called Shirley Audette was found killed in October 1969 in the downtown Montreal. The perpetrator left no signs of bloody skin apart from some savage bite-marks on the victim’s breasts.
In the same year, Archambault a jewelry clerk was found dead on the couch on 23 November. The killer left telltale teeth marks on the victim’s breasts after ripping the victim’s pantyhose and bra. Apart from a crumpled photograph found by the police, no suspected evidence was useful for the police.
On 16 January 1970, another victim called Jean Way, was killed by the perpetrator. The victim’s breasts were unmolestd in the criminal scene. The police found two small fibers under the victim’s fingernails.
The three murders happened in the same city Montreal. One year later, the perpetrator appeared in another city which was to the west of Montreal. On 18 May 1971, a high school teacher named Elizabeth Anne Porteous was found killed on her bedroom floor. The victim’s breasts were bitten by the perpetrator with some marks. The police recovered a broken cufflink amid the wreckage which was under the victim’s body.

Decision
The court sentenced Boden to 10 years into prison for his breaking and entering the victims’ houses, three criminal cases and three forcible rape murders from the year 1969 to the year 1971. He was sentenced to another 3 years in prison later when he was sent to the Kingston Penitentiary due to his escape from the prison.
Ratio Decidendi
The court sentenced Boden into prison due to his evil murder for the victims. The police had some bite-mark evidence which Boden left on the victims’ breasts and neck. Besides, by checkout, the worker Swann demonstrated 29 points of similarity in the evidence between the victim’s teeth and Boden’s teeth. The court thought that the evidence was sufficient to judge that Boden was guilty of these murders. So the court sentenced him into prison. What is more, the court thought that Boden’s means in the murders was merciless and inhuman. In order to give rise to the public’s caution about criminal, Boden should be punished heavily. What is more, in order to keep the victims’ families’ interests and consider their painful feeling, the sufficient evidence could be used to sentence Boden into prison.
My opinion
Personally speaking, I support the judgment of the court. Why? Firstly, I think the sufficient evidence under the present technological skills can indicate that Boden was guilty of the murders though the police only found the bite-mark evidence. Besides, I think the criminal Boden’s criminal was evil and inhuman which would cause many negative effects on the social harmony. So he should be punished heavily. Moreover, in order to consider the victims’ family members’ painful feelings, the sentence for Boden should be given timely for his evil behavior. Meanwhile in order to call the public’s awareness about the criminal cases, Boden should be punished and his behavior should be as teaching material by negative example. Last but not least, I think the behavior of Boden violated the social values which encourage the public to obey the law and cultivate their individual good characters. The judgement for Boden advocated the social justice. On basis of these reasons above, I think I support the court’s judgement for the criminal Boden.
Question 1: How does this case demonstrate a relationship between law and societal values?
Our society cannot tolerant murder, forcible rape and breaking and entering without any permission. The behavior of Boden violated the law who should be punished seriously. Meanwhile the judgement for Boden was also a negative example for the public which called the public to be aware of the criminal behavior. Moreover, it advocated good personal characters in the public life which could be accordant with the societal values.
Question 2: Does this case provide justice?
Yes. I think it was just for the court sentenced Boden into prison due to his evil criminals which had violated the law and the social values. What is more, the judgement comforted the victims’ family members. The public could make Boden’s criminal case as a negative example to advocate the justice in the social life.
