The case titled Campbell v. Acuff-Rose Music is a case in 510 U.S. 569 about the American Supreme Court copyright law concerning the establishment of the fact that a commercial parody is qualified as appropriate use. To put it more specifically, the petitioner is Campbell and the respondent is Acuff-Rose Music, Inc. And the advocate for the petitioner is Rogow and the advocate for the respondent is Rosdeitcher. Also, the case is decided by the Rehnquist Court, the lower court of which is the American Court of Appeals for the Sixth Circuit. It was argued on November 9th, 1993 and later settled on March 7th, 1994.
When it comes to the facts, Acuff-Rose Music, Inc. brought a suit against 2 Live Crew because the song of 2 Live Crew called “Pretty Woman” violated the copyright of Acuff-Rose Music, Inc. in Roy Oribison’s “Oh, Pretty Woman”. The District Court supported 2 Live Crew and it put forward that its song was actually a parody that took appropriate advantage of the original song. In the opposite, the Court of Appeals deemed that the commercial nature of this song’s parody is deduced to be unjust.
According to the above, the issue is whether the commercial parody of “Oh, Pretty Woman” by Roy Orbison can be seen as a just use according to the Copyright Act of 1976. And the decision is that a commercial parody is qualified as appropriate use and the reasoning is that no evidence can be applied to address either the market harm or the purpose and character of the use. As for this case, the dissenting opinion is that 2 Live Crew had definitely plagiarized from “Oh, Pretty Woman” by Roy Orbison. As a matter of fact, this dissenting opinion really makes sense because it has taken the parodic purpose of the use.
