It stands to reason that abortionists, as a whole, commit malpractice more often than doctors practicing legitimate medicine, because the industry is largely unregulated. Ironically, the nature of abortion confers some undeserved protection from malpractice suits. The victims are reluctant to have their medical history made public record. They may feel that they "deserved" whatever medical problems resulted from the malpractice as punishment for having had an abortion. Most women having abortions are in their early 20's and late teens. Concealing the abortion from family members may be a higher priority than suing for redress. Civil lawsuits are usually beyond the means of young women. Although lawyers typically would accept a medical malpractice case on a contingency fee basis (fees payable out of the settlement or verdict), plaintiffs are responsible for costs. These typically run between $50,00 and $100,000 in court costs, depositions, expert witness fees, transcript fees, and phone and photocopying charges.

The Women's Injury Network, Inc. (WIN) was founded in 1996 by Amy (Miller) McInerny with the unique focus of assisting victims of abortion malpractice to pursue their legal rights against negligent abortionists. Through counseling, litigation support and other services to women who have been maimed and even left sterile, and to the families of those killed, WIN is able see that

* the women and their families are compensated for their losses

* shoddy and incompetent doctors are held accountable-forced to pay higher insurance premiums or pay for the settlement or judgment out of pocket

* it becomes harder for the doctors to maintain insurance and even maintain their licenses, which eventually drives them out of business

* trial publicity exposes the dangers of abortion and the disregard for women's health and safety prevalent at too many clinics.

In addition to abortion malpractice litigation support, WIN has a "Speakers Bureau" program-making available volunteer speakers on abortion risks and aftermath to school and public groups-and a "Conference" program. If WIN's June 26 conference at Catholic University's Columbus School of Law is representative of its program, the group deserves whole-hearted support and admiration. Entitled "Meeting the Special Legal Needs of Women: The Abortion-Injured Plaintiff," the program brought together some of the country's top lawyers and medical professionals in the fields of trauma and malpractice litigation to educate the audience of primarily lawyers on key aspects of abortion malpractice litigation.

Dr. Anne Speckhard, a specialist in the psychology of trauma, clinician, researcher, expert witness and author explained the psychological and emotional aftermath of abortion. Nursing professor and frequent expert witness Patricia Fedorka, Ph.D. explained the significance of the "alphabet soup" of initials designating nursing degrees, certifications, specialties and "competencies" so that lawyers can find the expert witness best qualified to evaluate and testify on obstetrics/abortion malpractice. A panel of attorneys from the D.C. firm of Stein, Mitchell & Mezines discussed issues such as informed consent for abortion and the possibility of bringing suit based on the link between abortion and breast cancer. Attorney and law professor Teresa Collett rounded out the program with a thought-provoking discussion of the ethics of client selection and cooperation with evil.
