Death penalty refers to execution from a government or state usually but not always because they have committed a serious crime. Death penalty has been eliminating in recents years when various non-profit organization call for the abolishment of execution, such as Human Rights Watch. For instance, the council of Europe has abolished all death penalty in 2002 by 13th amendment of the Europe Convention on Human Rights (Council of Europe, 2002) and therefore, many european countries have abandoned death penalty as well, such as Norway, which will been mentioned in the following. But still, one third of the countries in the world have laws which make the death penalty legalized, including China, Japan, Iran and United States (Gustao, "", par.8). For example, on 24th June, 2014 in Shandong Province in China, Juan Li was sentenced to death based on the Criminal Law of China because she trafficked more than 2 kilograms drugs. Whether death penalty should be abolished is a controversial and heated topics. Personally, I think this legal punishment should be kept and maintained for it can frighten people who intend to commit crimes which could cause their death and help society safe and stable. In addition, if death penalty is abolished, the number of life imprison will surge dramatically.

Death penalty should exist in order to help society safe and stable. It can not only help to frighten the potential criminals but also help kind citizens to get rid of the threatening elements in their daily life. In 2011, Norway suffered a boom attack and a shooting conducted by a boy. Nearly a hundred people died in the two events that were and made by the same boy. However, as Norway has declaried the abolition of capital punishment and the law is too permissive, the boy was sentenced to imprisonment for 14 years and he could be released on parole. Norwegians worried about that the boy who caused the great harm cannot be executed. They feel scared that after 14 years, the boy walked in the streets again, and people did not know whether the boy would commit crimes again. According to the survey, 80% of Norwegians want the boy to be sentenced to death but the Norwegian law does not have relevant clauses (Yang, 2011). Similarly, in China, 92% of people reject the abolishment of death penalty for the same reason in accordance with a survey conducted by Tencent (Tencent, 2014). Based on the statistics mentioned above, it can be seen that death penalty helps to stabilize the society, by comforting other citizens and making them believe that criminals will be punished and that they will not harm citizens' rights and benefits any more.

Apart from the function mentioned above, if death penalty is abolished, the pressure of prisons will be tremendously large, since the most severe punishment, at that moment, is the life-long imprison. If the abolishment of execution does not help to reduce crimes which should have been sentenced to death, more criminals may be sentenced to life-long imprison and day after day, prisons cannot afford to support so much prisoners. For example, at least 1640,000 criminals were captured and put into jails, and 2,400 were sentenced to death penalty in 2014 in China. Try to imagine that death penalty were to be abolished, and all criminals who should have been sentenced to death, were put into prison. That means more than 1.65 million criminals were in jails and each year, new criminals will be added in this great number. In China, according to a survey there are only 681 prisons which contain approximately 1.7 million criminals and staff about 300 thousand in 2012 (Chen, 2012) and could not afford so many criminals. It can be seen that the abolish of death penalty will bring problems to the management of prisons and allocation or distribution of resources used in prisons.

Death penalty can scares people away from committing crimes that could get them killed. The ultimate purpose of death penalty is to prevent and reduce crimes. If this punishment is abolished, the awe of laws to citizens will be weakened and some people may intent to commit crimes to get benefits. Try to imagine which cost of committing a crime is much heavier: criminal's life, just a period of imprisoning or funding. For a certainty, the answer is criminal's life. Therefore, if criminals have to commit crimes at the cost their life, they may have a second thought and stop doing so. However, if they can commit crimes at the cost of money or imprisonment of several years, they may think that they still can get out the prisons and commit another crime. The cost of committing crimes is too light. Thus, it can be seen that death penalty have the function of scaring potential criminals.

Someone may consider the death penalty is crural torture of criminal, which disobey the principle of humanism and human rights. they think that it does not respect the life of criminals. Actually, the true disobedience to human rights and humanism is the misuse of death penalty. "Every sentence, punishment or penalty may be used unfairly or wrongly," Justice Douglas in United States once said, "what makes death penalty crural is the different application caused by the misuse of the right of free judge." (Douglas, 20) Therefore, the only way to prevent or reduce this different application is to perfect the las systems and standardize the application of the right of free judge.

Some scholars regard the abolishment of death penalty as the milestone of advanced civilization. They think that when the quality of citizens is sufficiently high and everybody obey laws, death penalty is useless and should be abolished. But at present, as evil elements in the society have not been eliminated, death penalty is still a powerful tool to scare the potential criminal and help to keep public order. If death penalty is abandoned, then the pressure of prisons will become heavier and the society may be more unrest. Hence death penalty should exist.[-Z]
